Terms of Service

1. Who these terms are for

Plumakids ("we", "us") is operated by Fernando Angulo. These terms ("Terms") form a binding agreement between Plumakids and the parent or legal guardian ("you") who creates an account. By creating an account or by allowing your child to use Plumakids, you accept these Terms and our Privacy Policy.

2. Age requirements & parental consent

Plumakids is designed for children aged 4–14, but accounts are only opened by parents or legal guardians. We do not allow anyone under 13 to create an account independently. Verifiable parental consent (COPPA) is collected during onboarding before any child information is recorded.

You confirm that you are at least 18 years old, that you have legal authority to consent on behalf of your child, and that the information you provide is accurate.

3. Your account

Account authentication is handled by Clerk. You are responsible for keeping your login credentials secure. Notify us immediately if you suspect unauthorized access. You may delete your account, every child profile, and all associated data at any time from your account settings — deletion is permanent and cascades through our entire system.

4. Who owns the stories

Your child owns the stories they write. Plumakids holds a limited license, granted by you on your child's behalf, to host, display, and process those stories solely to run the service — for example, to render them in the editor, generate the polished book version, produce audio narration, generate cover and portrait images, and (only with your explicit opt-in) display them in the public Discover feed. You may revoke this license at any time by deleting the story or your account.

5. AI-generated content

Plumakids uses third-party AI services (Anthropic, ElevenLabs, fal.ai, Google) to assist with writing prompts, generate hero portraits, book covers, polished story versions, and voice narration. These outputs are produced from your child's inputs and the system prompts we author. AI-generated content is provided "as is"; we cannot guarantee uniqueness, accuracy, or copyright clearance against the entire body of works in existence. You and your child may use Plumakids-generated images and audio for personal and non-commercial use. Commercial republication of AI-generated outputs is not permitted under these Terms.

6. Sharing & moderation

Stories are private by default. Making a story public requires an explicit toggle in the story settings, and every publish is run through automated content moderation before it appears in the Discover feed. We reserve the right to remove any public story that violates these Terms or community guidelines. Reversing visibility to private is available at any time.

7. Acceptable use

You and your child agree NOT to use Plumakids to: produce or share content depicting violence against real people, sexual content involving minors, hate speech, harassment, instructions for harm, or private personal information about other people. You also agree not to attempt to bypass our safety systems, abuse the AI for non-creative-writing purposes, scrape the service, or impersonate another user. Violations may result in immediate account suspension.

8. Service availability

Plumakids is currently in alpha and is offered free of charge. We do not guarantee uptime, feature stability, or data preservation across major redesigns. We will give reasonable advance notice before any breaking change to your account or saved stories. A paid subscription is planned in the future; if introduced, you will be notified and given the option to continue on the free tier (with reduced features) or to upgrade.

9. Changes to these Terms

We may update these Terms when the service changes materially. We will notify the email on your account at least 14 days before any change takes effect that meaningfully reduces your rights. Continued use of Plumakids after the effective date constitutes acceptance.

10. Disclaimer & liability

Plumakids is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose). Our aggregate liability to you for any claim arising out of or relating to these Terms or your use of Plumakids will not exceed USD $50 or the amount you have paid us in the past twelve months, whichever is greater. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

You may stop using Plumakids and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a safety risk. On termination, your right to use Plumakids ends immediately; provisions concerning content ownership, acceptable use, disclaimers, liability, and dispute resolution survive.

12. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought in the competent courts of Madrid, Spain. Nothing in this section prevents you from raising consumer-protection rights available under the laws of your country of residence.
