Terms of Service

1. Who these terms are for

Plumakids ("we", "us") is operated by Fernando Angulo. The private pilot is currently limited to families in Spain. These terms ("Terms") form a binding agreement between Plumakids and the parent or legal guardian ("you") who creates an account. By creating an account or by allowing your child to use Plumakids, you accept these Terms and our Privacy Policy.

2. Age requirements & parental consent

The Spain private pilot is limited to children aged 9–12, and accounts are only opened by parents or legal guardians. We do not allow a child to create an account independently. During onboarding, the adult account holder confirms their parental or guardianship authority and gives consent before a child profile is created. This confirmation does not independently verify the adult's identity, and the consent method remains under legal review for this pilot.

You confirm that you are at least 18 years old, that you have legal authority to consent on behalf of your child, and that the information you provide is accurate.

3. Your account

Account authentication is handled by Clerk. You are responsible for keeping your login credentials secure. Notify us immediately if you suspect unauthorized access. You may delete your account, every child profile, and associated data at any time from your account settings. Deletion is permanent; primary records are erased immediately and provider cleanup is retried and checked under the Privacy Policy.

4. Who owns the stories

Your child owns the stories they write. Plumakids holds a limited license, granted by you on your child's behalf, to host, display, and process those stories solely to run the private service — for example, to render them in the editor and generate the polished book version. New AI cover and portrait generation is disabled during this pilot. You may revoke this license at any time by deleting the story or your account.

5. AI-generated content

Plumakids uses Anthropic to assist with writing prompts and polished story versions. Google Gemini, fal.ai, and new AI image or narration generation are disabled during this pilot. You are interacting with AI when a Story Spirit or another AI guide responds. The AI-assisted book edition is identified in the experience, and AI output can contain mistakes. These outputs are produced from your child's inputs and the system prompts we author. AI-generated content is provided "as is"; we cannot guarantee uniqueness, accuracy, or copyright clearance against the entire body of works in existence. Commercial republication of outputs is not permitted under these Terms.

6. Sharing & moderation

Stories are private. Discover and anonymous public links are disabled during the private pilot. Enabling either surface requires a separate Public Sharing Ready decision after the reporting, review, appeal, moderation, and kill-switch controls have passed their release checks. A parent approval alone does not reopen those surfaces.

7. Acceptable use

You and your child agree NOT to use Plumakids to: produce or share content depicting violence against real people, sexual content involving minors, hate speech, harassment, instructions for harm, or private personal information about other people. You also agree not to attempt to bypass our safety systems, abuse the AI for non-creative-writing purposes, scrape the service, or impersonate another user. Violations may result in immediate account suspension.

8. Service availability

Plumakids is a limited private pilot offered free of charge. Features may change or be unavailable. We will use reasonable care to operate the service and will give reasonable notice before a planned material change that affects saved stories, unless an urgent security or legal issue requires immediate action.

9. Changes to these Terms

We may update these Terms when the service changes materially. We will notify the email on your account at least 14 days before any change takes effect that meaningfully reduces your rights. Continued use of Plumakids after the effective date constitutes acceptance.

10. Disclaimer & liability

The private pilot may contain errors and AI output may be inaccurate. Nothing in these Terms excludes or limits mandatory consumer rights, statutory guarantees, or liability that Spanish or EU law does not permit us to exclude or limit.

11. Termination

You may stop using Plumakids and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a safety risk. On termination, your right to use Plumakids ends immediately; provisions concerning content ownership, acceptable use, disclaimers, liability, and dispute resolution survive.

12. Governing law

These Terms are governed by the laws of Spain. A consumer may bring a dispute before the courts that are competent under applicable consumer and procedural law. Nothing in this section removes mandatory protections available where you reside.
